Information clause for people participating in recruitment processes organized by Scalo In accordance with our obligation to provide information under Article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (GDPR), we hereby inform you about the processing of your personal data: Who processes your data? The controller of your personal data processed in connection with recruitment is Scalo spółka z ograniczoną odpowiedzialnością with its registered office in Wrocław, at ul. Powstańców Śląskich 9, 53-322 Wrocław, KRS number: 0000290107 (Scalo). What is the purpose and legal basis for Scalo processing your personal data? Your personal data will be processed for purposes related to recruitment processes, i.e. for the purposes of conducting recruitment processes, namely for the following purposes: a) to organize and conduct the recruitment process for which you have submitted your CV or other application to be considered as a candidate in this recruitment process the basis for the processing of your personal data in this regard is the necessity of processing to fulfill Scalo's legal obligation under labor law (Article 6(1)(c) of the GDPR), and, where applicable, consent to the processing of personal data for this purpose (Article 6(1)(a) of the GDPR) or the necessity of processing to take action at the request of the data subject prior to entering into a contract (Article 6(1)(b) of the GDPR); b) for the purpose of organizing and conducting future recruitment processes at Scalo the basis for the processing of your personal data in this regard will be your consent to the processing of personal data for this purpose (Article 6(1)(a) of the GDPR); with regard to former employees of Scalo, processing may also take place in connection with the necessity of such processing for the purposes of the legitimate interests pursued by Scalo, consisting in the possibility of re-establishing cooperation with persons previously employed by Scalo (Article 6(1)(f) of the GDPR); c) c in order to pursue claims or defend against claims - the basis for the processing of your personal data in this regard is the necessity of such processing for the purposes of the legitimate interests pursued by Scalo, consisting in the possibility of pursuing claims or defending against them (Article 6(1)(f) of the GDPR), d) to avoid the risk of re-recruiting persons who did not meet the requirements specified for recruitment for a given project the basis for processing in this regard is the necessity of such processing for the purposes of the legitimate interests pursued by Scalo related to the economics of the recruitment process and not repeating recruitment activities with regard to persons who have been found not to meet the requirements for a specific project (Article 6(1)(f) of the GDPR). Providing personal data is voluntary, but providing contact details and information related to the candidate's qualifications and experience is necessary to participate in the recruitment processes organized by Scalo. What are your rights vis-à-vis Scalo with regard to the data processed? 1. You have the right: a. to access your data and receive a copy thereof; b. to rectify (correct) your data; c. to erase your data, restrict the processing of your data; d. object to the processing of your data; e. transfer your data; f. lodge a complaint with the supervisory authority, i.e. the President of the Personal Data Protection Office with its registered office in Warsaw, address: ul. Stawki 2, 00-193 Warsaw. 2. If Scalo uses tools based on artificial intelligence models in the recruitment process, you have the right to: a. not be subject to decisions based solely on profiling; b. object to automated decision-making; c. request that your application be reviewed by Scalo staff. 3. With regard to processing based on your consent, you have the right to withdraw your consent to the processing of your personal data at any time, with the proviso that this does not affect the lawfulness of the processing that was carried out on the basis of your consent prior to its withdrawal. Who do we share your personal data with? Your data may be transferred to other entities to the extent that these entities provide Scalo with services related to the organization and conduct of the recruitment process. If the recruitment process is for a specific project to be carried out for a specific Scalo client, your personal data may be shared with that client, in particular for the purpose of consulting with members of the project team who are to be involved in the implementation of that project. In addition, Scalo reserves the right to ask you for separate consent to transfer your personal data to Scalo's clients for whom Scalo carries out projects. If you give your consent for marketing and promotional purposes, your data may also be made available to entities supporting Scalo in the implementation of promotional and marketing activities. Your data may also be transferred to Microsoft Corporation (address: One Microsoft Way, Redmond, WA 98052, USA) as part of the use of artificial intelligence-based tools, i.e., Azure Open AI, in the recruitment process. How long do we store your personal data? Your personal data will be processed by Scalo: a) on the basis of consent for the current recruitment process until the end of the recruitment process, but no longer than for 6 months, b) on the basis of consent for future recruitment processes until consent is withdrawn, but no longer than for 3 years, c) on the basis of legal obligations for the period specified in the relevant regulations, d) on the basis of the legitimate interest of the controller related to the pursuit of claims or defense against claims until the end of the limitation period for claims and for a maximum of one year longer, e) on the basis of the legitimate interest of the controller related to re-establishing cooperation with persons who have previously cooperated with Scalo for the period of storage of data in connection with employment that has ceased, i.e. for persons employed on the basis of an employment contract, 10 or 50 years depending on the date of employment, and for persons cooperating on the basis of a civil law contract, for the period of limitation of any possible claims against Scalo, f) on the basis of the controller's legitimate interest in order to avoid the risk of re-recruiting for a given project persons who did not meet the previous requirements specified for recruitment for that project the period will be determined taking into account the duration of the recruitment process for a given project, but the maximum period is 1 year. Do we transfer your data to countries outside the European Economic Area? Your data may be transferred to countries outside the European Economic Area, including in particular to countries such as Switzerland, the United States, or the United Kingdom. However, please note that your personal data may also be transferred to other countries, depending on the location of the client for whom the project is to be carried out, in connection with which the recruitment process is conducted at Scalo. For some countries to which your personal data will be transferred, the European Commission has issued a decision stating that an adequate level of personal data protection is ensured in those countries (e.g., the United Kingdom; Switzerland). For other countries, the European Commission may not have issued an appropriate decision, and in these cases, Scalo will assess whether it is possible to provide adequate safeguards for your personal data before transferring it. If Scalo uses a tool based on Azure Open AI artificial intelligence models during the recruitment process, your personal data provided to Scalo in your CV or other application may be transferred to countries outside the European Economic Area, in which case the transfer of data will be carried out using standard contractual clauses (SCC) developed by the European Commission. Will your personal data be used for automated decision-making (including profiling)? Your data may be used for automated decision-making using the Azure Open AI tool, including profiling in the form of automated analysis of personal data. Automated decision-making will concern determining the extent to which you meet Scalo's requirements as specified in the recruitment process. Will your personal data be used to train artificial intelligence models? No, your data will not be used to train AI models.
